<b>MINIMUM WAGES CAN BE SPLIT INTO ALLOWANCES</b><br />

In the appeal against the order of the EPF Authority under section 7A of the Act the appellant have stated that directing the appellant to deposit the dues is illegal as the EPF Authority has assessed the dues considering the allowances as ‘basic wages’.<br />
<br />
The EPF Appellate Tribunal observed that the provident fund contribution is to be calculated on the basic wages and not upon the wages fixed under the Minimum Wages Act as already settled by the Punjab & Haryana High Court in the case of APFC Gurgaon vs. M/s. G4S Security Services (I) Ltd., 2011 LLR 316. Fixation of wage structure is within the domain of the employer. Wages can be split into allowances. Hence, order of the EPF Authority cannot sustain and appeal is allowed.<br />

<b>EMPLOYER - NOT PROVIDENT FUND AUTHORITY CAN FIX WAGES FOR CONTRIBUTIONS</b><br />
<br />
The grievance of the appellant in the appeal is that the order dated 25.06.2010 passed by the EPF Authority under section 7A of the Act that the employer is liable to pay contributions under the Act on the wages as fixed under the Minimum Wages Act and not the actual wages paid to the workmen is illegal.<br />
<br />
The Appellate Tribunal observed that the contribution under the Act is to be paid upon the ‘basic wages’ as defined under the Act and not upon the wages fixed under the Minimum Wages Act as also held by the Punjab & Haryana High Court in the case of APFC Gurgaon vs. M/s. G4S Security Services (I) Ltd., 2011 LLR 316. Hence, the impugned order of the EPF Authority is set aside and appeal allowed.<br />

<b>ROLLING OF PAPAD NOT COVERABLE UNDER THE PROVIDENT FUND ACT</b><br />
<br />
By filing the appeal, the appellant has questioned the validity of the order, passed by the EPF Authority under section 7A of the Act stating that the appellant does not fall under any of the heads in the ‘schedule I’ appended to the Act as the establishment/industry of the appellant has not yet been notified in the scheduled head u/s 1(3)(a) or 1(3)(b) of the Act.<br />
<br />
The Appellate Tribunal observed that the EPF Authority has covered the establishment of the appellant relying on the case M/s. Shri Mahila Griha Udyog Lijjat Papad decided by the Supreme Court but in fact that case was not contested by the proprietor, Mrs. Pushpa Berry, of M/s. Shri Mahila Griha Udyog Lajjat Papad and in that case the Counsel of Mrs. Pushpa Berry/appellant had comfortably agreed to make compliance under the provisions of the Act and the Supreme Court passed order relying upon the consent of the petitioner/establishment. Hence, the ratio of that case has no binding effect upon any other case. The appellant establishment cannot be brought under the purview of the Act in the absence of any scheduled head for coverage of such establishment. Impugned order suffers from infirmity and quashed. Appeal is allowed.<br />

<b>CLUBBING 4 ESTABLISHMENTS FOR COVERAGE - WHEN NOT PROPER</b><br />
<br />
By filing the appeal, the appellant has questioned the validity of the order, passed by the EPF Authority under section 2A of the Act stating that clubbing of 4 establishments in the absence of elements of inter-dependability, functional and financial integrality between the establishment is not justified.<br />
<br />
The Appellate Tribunal observed that Employees’ Provident Funds & Miscellaneous Provisions Act applies upon an establishment employing 20 or more than 20 employees even for one day. However, an ‘establishment’ does not mean that it should be one only since 2 or more establishments can be clubbed together provided there is inter-dependability upon each other, common supervisory control, jeographical proximity, functional and financial integrality. In this case, there were 4 establishments known as M/s. Pavizham Jewellers, M/s. Pavizham Jewellers India Pvt. Ltd., M/s. Pavizham Galaxy India Pvt. Ltd. and M/s. Pavizham Jewel City. Enquiry Officer concluded that Managing Directors of all the 4 units are family members, engaged in same business having financial integrality and clubbed them for determination of PF dues. There is no common financial, managerial, functional and supervisory control. Each unit is independent having independent set of employees. Merely extending financial facilities to any other establishments or one person being Managing Director of more than one units itself may not be sufficient to establish that one is the branch of another. There are no findings of the Enquiry Officer that four establishments are inter-dependant on each other or there exists functional integrality between these units or there is a possibility that if one establishment is closed, others would not survive. Hence, order of the EPF authority and that of the EPF Appellate Tribunal suffers from serious infirmities and liable to be quashed. The appeal is allowed.<br />

<b>APPRENTICES UNDER STANDING ORDERS - NOT TO BE COVERED BY PROVIDENT FUND ACT</b><br />
<br />
M/s. Sri Shanmugavel Mills (P) Ltd. filed an appeal before the Employees’ Provident Fund Appellate Tribunal putting forth its grievance that the EPF Authority has determined the PF dues treating the apprentices engaged well within the scope of the Certified Standing Orders as regular workers which is illegal.<br />
<br />
The EPF Appellate Tribunal observed that the Investigating Officer has not recorded any evidence to establish the employment of the apprentices to be as of regular workers. As per Certified Standing Orders, the apprentices are to be engaged for a specified period of three years and on completion, they are to be issued certificates. Apprentices were paid stipend. No evidence is there to establish that apprentices were engaged in actual operations of the appellant. The apprentices so engaged have no right to regular appointment. They are trainees engaged for a limited period. Hence, impugned order is not sustainable and set aside.<br />

<b>DAMAGES FOR LATE DEPOSIT WHEN LEVIED IMPROPERLY - TO BE DECIDED AGAIN</b><br />

The appellant filed an appeal before the Employees’ Provident Fund Appellate Tribunal against the order dated 9.7.2008, passed by the EPF Authority, putting forth its grievance that while levying damages, the EPF Authority has not considered the reasons given by the appellant for late deposit and imposition of damages to the uppermost limit is illegal.<br />

The Tribunal observed that as per section 14B and Regulation 32A of the Act, the adjudicating authority is not bound to act mechanically in applying the uppermost limit of the damages. Impugned order indicates that the Enquiry Officer has not followed the law in its correct perspective. There is no finding that the appellant has willfully or deliberately withheld the PF contribution. Hence, the impugned order is set aside and the matter is remanded back to the EPF Authority to initiate fresh proceedings and decide the matter to meet the ends of justice.<br />

There were two questions related to Minimum Wages Act and also the Bonus Amendment Act. <br /></span><br />As per the Minimum Wages Act every employer employees one or more of employees would be covered under the Minimum Wages ACt. All the information related to AP Minimum wages from 1998 to till date are mentioned in this link. <br /><br />The link also specifies the industry covered and the rates thereon.<br /><span style="font-weight:bold;">http://labour.ap.gov.in/mingos.jsp<br /></span><br />The amendments to the Bonus act are specified as below ( The details are covered as part of www.paycheck.in of IIMA ): <br /><br /> <br /><span style="font-weight:bold;">The Payment of Bonus (Amendment) Bill, 2010</span><br /> (Please do ask us for a copy of the amendments gist in pdf which we could not upload) <br /><br />The Payment of Bonus Act, 1965 is the principal act for the payment of bonus to the employees which was formed with an objective for rewarding employees for their good work for the organization. It is a step forward to share the prosperity of the establishment reflected by the profits earned by the contributions made by capital, management and labour with the employees. Recently a Bill has been drafted for further amendment of the Act. This may be enacted by Parliament in the Sixty-first Year of the Republic of India. The Act may be called as the Payment of Bonus (Amendment) Act, 2010 and it shall come in force on such date that the Central Government may notify by the Official Gazette appointed.<br /><br />Amendments that proposed are as follows: (Please note that the bill is yet to be placed in the Parliament)<br /><br />Amendment in Section 2 of the Act: It is proposed to make amendment in Section 2 clause 13 which defines “employee” and who can be covered under the Act. “employee” means any person (other than an apprentice) employed on a salary or wage not exceeding [three thousand and five hundred rupees] per mensem in any industry to do any skilled or unskilled manual, supervisory, managerial, administrative, technical or clerical work for hire or reward, whether the terms of employment be express or implied. In this the word “three thousand and five hundred rupees” is to be substituted by “ten thousand rupees”.<br /><br />Amendment in Section 10 of the Act: Section 10 is known as “Payment of minimum bonus” and which provides details regarding minimum amount of payable bonus to eligible employees. This move will benefit 4.70 crore organised sector workers. Corporates which run their own PF trusts will also have to match the new rates. <br /><br />In fact, while the official interest rate is 9.5%, the actual rate of return works out to 13.8% (assuming investment of Rs 70,000 for the year in the instrument). That's because tax is saved both on the principal invested as well as the interest, translating into a very healthy return post tax, which is almost double that provided by fixed deposits (see graphic). <br /><br />Wednesday's increase took the EPF interest rate to a five-year high and was made possible due to the surprise discovery of nearly Rs 1,700 crore in the suspense account -- meant for unclaimed PF money. The windfall was discovered after the central board of trustees last year ordered a review of all EPF accounts since 1952. <br /><br />The decision of the board of trustees, headed by labour minister Mallikarjun Kharge, to hike the interest rate will be forwarded to the finance ministry for its notification. The 9.5% interest rate will result in an additional outgo of Rs 1,600 crore, which will be used from the surplus of Rs 1,731 crore in the interest suspense account of EPFO. <br /><br />Kharge told reporters that the EPFO trustees had decided not to invest in the stock markets and would continue to follow the existing investment pattern. "We had received a letter from the finance ministry asking for parking of a portion of EPFO funds in the stock market. We have received huge opposition from CBT members who oppose the idea of investing in stock markets," Kharge said. <br /><br />The EPFO maintains a huge corpus of over Rs 300,000 crore, whereas all recognised PFs managed by it have accumulated funds to the tune of Rs 200,000 crore. <br /><br />Deepankar Mukherjee, CITU national secretary who was part of the board decision, said this was a short-term measure but the government must ensure that workers get a higher interest given the fact that there is high inflation and funds are parked in government securities. <br /><br />"The interest rate was as high as 12% not very long ago. It was brought down as the government felt inflation had come down substantially. Now that inflation is in double digits, it must announce an additional interest subsidy as stimulus," Mukherjee said. <br /><br />Between 1989-90 and 2000, the rate of interest on PF was 12%. It was reduced to 11% in July 2000 and thereafter the slide began. The reason for fall in interest rates was overall fall in interest rates in banks and lower inflation. <br /><br />Minister of state for labour Harish Rawat clarified that the raise of an additional 1% is just for this year. Next year, the earnings of EPFO will determine the rates. "We found a surplus of Rs 1,731 crore in the suspense account and we put that before the CBT to decide," the minister said. <br /><br />In another important decision, the board of trustees decided to stop paying interest on "inoperative accounts", thus reducing the interest burden on account of those who use this fund as an investment destination. "The accounts which are not operated for 36 months will stop getting interest," he said. <br /><br />D L Sachdev, AITUC national secretary, welcomed the decision, but said this was only a one-time security. Here is an employee who has to give 2 months notice when he resigned... The first month passed with notice.. salary processed normally... second month he worked for 15 days and disappeared. He/she comes back after one month and asks for relieving ( In some cases the 15 days salary) In this case what do you do to close the exit logically. <br /><br /><span style="font-weight:bold;">Purpose of Notice Period: </span><br />Is to ensure that the organisation can plan allocation of work and responsibility to other resources hence least inconvenience to customers.
